Conflict over works council at Sixt in Frankfurt: Verdi fails with application for works council election board

In the conflict over the establishment of works councils at the car rental company Sixt, the Verdi trade union failed in the first instance. The Frankfurt Labour Court has rejected the union’s application to appoint an election board by court. Initially, nothing was communicated about the reasons. According to a spokeswoman, the union is examining whether to appeal to the Hesse State Labour Court.

The process was preceded by a fierce conflict at the car rental company, which does not have a works council at any location with more than 7,000 employees worldwide. At Frankfurt Airport with around 30 employees, an election board was supposed to be elected in October last year, but three out of four initiators were confronted with dismissals without notice immediately before the decisive meeting.

Something similar had happened at Düsseldorf Airport, so that Verdi raises the accusation against the company of deliberately obstructing the planned works council elections. In particular, the formation of a group works council should also be prevented, which would be possible with two committees in different places.

Company rejects allegations

The company strictly rejects this. The Sixt press office explains: “It is solely up to the workforce to decide whether they want a works council. If the workforce wants a works council, Sixt will support this.” The dismissals in Düsseldorf have nothing to do with the election preparations there and in Frankfurt it is about personal misconduct of the employees. It is assumed that the labour court will confirm the dismissals against the former employees.

In the proceedings, Verdi has now tried to have the employees threatened with dismissal appointed by the court as election board. In addition, the Verdi lawyer appointed three trade union secretaries as substitute members of the body, which is to enable the election of a works council. The company had expressed doubts that the three employees were union members at all. However, this is a prerequisite for Verdi’s right to sue. (dpa-AFX/gem)
